Аннотация: Article is dedicated to I.Y. Foynitskii contribution in the determination of the place for adversary character in the Russian criminal proceedings. The author emphasizes that I.Y. Foynitskii the century forward indicated the strategic direction of the Russian theory of criminal proceedings; his indisputable merit consists in the fact that he very clearly designated the trend of development of criminal proceedings generally. He was the representative of the direction, which considers adversary character as the method of organizing the activity within the framework of the judicial debate, whose participants were authorized to give accusatory and defensive arguments, whereas as a whole the proceedings were considered as public. His basic efforts with the study of the problem about the adversary character were directed toward the highlight of the special features of Russian adversary character in comparison with the Anglo-American.
